Copyright
Law and Fair Use
United
States Code 17 Section 107 allows copying for purposes
such as criticism, comments, news reporting, teaching
(including multiple copies for classroom use), scholarship
or research.
Factors
used to determined "fair use" include:
- Purpose and
character of use, including whether such use is of
a commercial nature or has a nonprofit educational
purpose.
- Nature of
the copyrighted work
- Amount and
substantiality of the portion used in relation to
the copyrighted work as a whole.
- Effect of
the use upon the potential market for or value of
the copyrighted work
- Further

- Electronic
Reserve
American
Library Association guidelines to which the
library and music seminar room subscribe:
- Copy
material in a reasonable amount. The amount of readings
should not take the place of a purchased textbook.
- Include
bibliographic information and a notice of copyright
with the material.
- Obtain
copyright permission from the copyright owner and
furnish a signed statement (copyright
release form) indicating that use of the photocopies
does not violate current copyright law.
- Audio
tapes, video tapes, DVD's and CDs may be used unless
the work is itself an illegal copy or the purpose
is a "public performance" of the work.
