Copyright Form

Copyright Release Form: this form may be emailed or printed, signed and returned to 117 Cushwa-Leighton Library.

A signed copyright release form, or, alternatively, this copyright release form email, is required for photocopies, reproductions and/or audio visual recordings indicating that (1) you have obtained permission from the copyright holder to use these materials and/or (2) that the use of these materials are in compliance with and does not violate current copyright law is. Copyright information is available in the library, in "Copyright Law and Fair Use Guidelines", the American Library Association guidelines, and through Copyright Information sources.

In accordance with the Copyright Law of the United States (rev. 1999), the library can accept only one photocopy of any item for course reserve. In some instances the use of audio visual recordings may be considered a public performance and subject to copyright laws.

NOTICE WARNING CONCERNING COPYRIGHT RESTRICTIONS

The Copyright Law of the United States (Title 17, United States Code) governs the making of photocopies or other reproductions and use of copyrighted material.

In accordance with the Copyright Law, the library can accept photocopies or scan materials for traditional course reserve or electronic course reserve purposes. Information about copyright law and "fair use" is available in the library as well as on the Library's web site. Reproductions may not be "used for any purpose than private study, scholarship, or research." If a user makes a request for, or later uses a photocopy or reproduction for purposes in excess of "fair use," that user may be liable for copyright infringement.

It is the intention of Saint Mary's College, the Cushwa-Leighton Library and Music Seminar Room to comply with both the spirit and letter of current copyright law.

By FURNISHING A SIGNED STATEMENT, or, in the alternative, SENDING THIS E-MAIL, I, the undersigned, hereby certify that the reproductions, audiovisual materials, and other materials which I have placed on traditional or electronic course reserve (via Blackboard) for the semester for course number(s) are either: 1) compliance with the Copyright Law of the United States (rev. 1999); 2) are not covered by the Copyright Law; 3) are in compliance with a lawful exemption to the Copyright Law; or 4) are being used with the obtained permission of the copyright holder.

I likewise agree to indemnify and defend both Saint Mary's College and Cushwa-Leighton Library employees from any alleged or actual violation of existing copyright law resulting from my actions and/or omissions.
